1.-The price:

The price of the trips contracted on the Machupicchu Chaska Explore Travel Agency website is established based on the services and dates selected by the user, and will depend on the number of people included in the reservation.

It is the user’s responsibility to review the “price includes” and “price does not include” sections of the offer, before completing the purchase process. They detail exactly all the services included in the reservation.

2.- Requests for cancellation and modification by the User

2.1. Cancellations

In the event that the User wishes to request the cancellation of their reservation, they must send an email to the address: info@machupicchuchaskaexplore.com

If there are specific cancellation conditions for a given trip, they will be indicated in the “conditions” section of the offer. If there are no specific conditions, the cancellation fees detailed below will apply.

  1. Management fees, corresponding to 10% of the total amount of the reservation.
  2. Cancellation expenses, if any, corresponding to the total cancellation expenses imposed by the suppliers.
  3. Modifications

In the event that the User wishes to request a modification in relation to the dates or people included in his reservation, he must send an email to the address: reservas@machupicchuchaskaexplore.com

Requests received from the moment of making the reservation up to seven days before the start of the trip will be attended.

Machupicchu Chaska Explore Travel Agency will take the appropriate steps with the hotel or provider of the services included in the reservation, and will inform the user if it is possible or not to make the requested modification. The User must pay the justified additional expenses originated by the requested change.

3.- CANCELLATIONS AND ALTERATIONS:

3.1.- Cancellation by us:

Machupicchu Chaska Explore Travel Agency EIRL reserves the right to cancel a program in the event of any of the following circumstances:

The interruption, of the client to make the prepayment as agreed with our travel agent who is in contact (according to the booked program) before the departure date. In this case, the client will not be entitled to a refund of the deposit.

Force majeure:  Inability to operate the program due to unusual or unforeseen circumstances beyond the control of Machupicchu Chaska Explore Travel Agency. Namely. Delays in departures of travel itineraries caused by technical problems, weather conditions, overbooking or closing of a hotel, strikes, riots, decisions of state governments or tourism organizations that alter the itinerary, the time spent in a city or even skipping a city or part of the itinerary due to the local situation.

In such cases, Machupicchu Chaska Explore Travel Agency EIRL propose viable solutions to operate the comparable program or travel plan. If any of the above circumstances occur during the course of the visit, we reserve the right to modify the scheduled itinerary accordingly and no compensation will be paid. We will make every reasonable effort to provide you with the booked program arrangements, although changes may arise. If they are significant we will see, if possible, we will inform you before the departure date.

Once again, we will offer comparable alternative arrangements. All additional expenses derived will be borne by the client. Please note that the Machupicchu Chaska Explore Travel Agency will not be responsible for reimbursing additional expenses incurred by the client in the preparation of the tour, this includes international tickets, the allocation of miles used and fees, cost of visas, vaccinations, among others.

3.2.- Alterations on your part:

If the client requests any modification to the initial travel arrangements after the reservation is confirmed, no modification penalty will be paid unless the program materially changes its nature. Upon request for additional services, such as train or program tickets, etc., the Machupicchu Chaska Explore Travel Agency will charge an additional fee for each requested service. If, as a result of the modification, Machupicchu Chaska Explore Travel Agency had to bear communication expenses and other significant expenses, these would be borne by the client.

If modifications are requested after the start of the tour, Machupicchu Chaska Explore Travel Agency will do everything possible to implement them, but we cannot guarantee that it will be possible. In the event of making such a change, the client will be responsible for the cancellation/retention expenses that may be received for the previously reserved service and for the expenses incurred by Machupicchu Chaska Explore Travel Agency in the attempt to ensure any revised service.

3.3.- Cancellation by you:

In case of cancellation by the client, it must be notified to the Machupicchu Chaska Explore Travel Agency, by email (reservas@machupicchuchaskaexplore.com). Please note that the program deposit is non-refundable (depending on how far in advance you notify us). This notification will only be considered made upon receipt of the email, since we can only act upon receipt of it. Please indicate the reason for the cancellation.

3.4.- In personalized programs:

If the cancellation notification is received more than 60 days before departure, the client will lose 10% of the prepayment. For notifications received within 60 days of departure, the cancellation fees are as follows:

60 to 31 days: 50% of the prepaid price.

30 to 16 days: 75% of the program price.

15 to the day of departure 100% of the price of the program.

3.5.- For walks and expeditions:

If the cancellation notification is received more than 30 days before departure, the client will only lose the deposit. For notifications received within 30 days prior to departure, the cancellation fees are as follows:

30 to 16 days: 75% of the program price.

15 to the day of departure 100% of the price of the program.

Cancellations received on Friday for program outings that weekend (Saturday, Sunday, or Monday) will be treated as outing cancellation days. We cannot give any compensation or reimbursement for meals, rooms, excursions, etc. not made, when these are included in the price of the excursion.

No refunds will be made for services canceled or not used at all.

All reimbursement expenses derived from a cancellation on your part will not be assumed by the Machupicchu Chaska Explore Travel Agency.

3 – Cancellation and modification of the trip by the organizer

3.1. Modification of the trip by the organizer

Before departure, Machupicchu Chaska Explore Travel Agency may make the changes that are necessary for the good end of the combined trip and that are not significant. The necessary changes are considered significant if they impede the achievement of its purposes according to its general or special characteristics.
In the event that the Machupicchu Chaska Explore Travel Agency is forced to make significant changes, it will immediately notify the User. The latter may choose between accepting the modification of the contract specifying the changes introduced and their impact on the price, or terminating the contract. The consumer must communicate the decision adopted to the agency within three days after being notified of the modification. If the consumer does not communicate his decision within the indicated period, it will be understood that he opts for the resolution of the contract.

3.2. Cancellation of the trip by the organizer

  1. The cancellation of the trip, for any reason that is not attributable to the consumer, gives you the right to terminate the contract with the rights provided in these General Conditions of Use.
  2. If the cancellation of the trip is communicated within the two months prior to departure, the Machupicchu Chaska Explore Travel Agency must pay the consumer compensation based on the time remaining for the departure, which will be:
    1. 5% of the price of the trip if it occurs more than 15 days in advance and less than 2 months in advance.
    2. 10% of the price of the trip, if it occurs between 15 and 3 days in advance.
    3. 25% of the price of the trip, if it occurs within 48 hours prior to departure.

There is no obligation to compensate in the following cases:

1. When the cancellation of the trip is due to force majeure. The causes of force majeure are circumstances beyond the control of the Machupicchu Chaska Explore Travel Agency, abnormal and unforeseeable whose consequences could not have been avoided, despite having acted with due diligence.

1.  Lack of presentation at the exit

There will be a failure to show up at the exit if the consumer does not communicate their wish not to make the trip and does not show up at the time and place scheduled for departure.

In this case, you lose the right to a refund of the amounts delivered and continue to be obliged to pay those that are pending payment.

If the lack of presentation occurs due to force majeure, the consumer will be entitled to a refund of the amounts delivered, except for the management costs and the cancellation costs of the reservation at that time.

For these purposes, and without limitation, the death, accident or serious illness of the consumer or any of the people with whom he lives or any similar assumption that prevents him from participating in the trip and communicating said impossibility to the agency before departure. .

1. Voluntary changes and early returns

In the event that the client, once the trip has started, voluntarily requests any modification of the contracted services (eg overnight stays, hotel changes or itineraries), the prices of the tourist services may not correspond to those published in the offer that gave rise to to contract Carrying out this type of procedure will entail some minimum expenses depending on the type of offer. Consult in each case.

In this case, the transfers between hotels will be borne by the client, and the client must also assume the management costs, as a result of the processing of the new reservation made, or the change of the requested flight.

In case of abandonment of the establishment before the contracted date due to force majeure, Machupicchu Chaska Explore Travel Agency does not undertake to make any refund.

1. Passports and visas

It is the responsibility of the user to verify that the personal and family documents of all passengers (including children) are in order and comply with the validity period. In the case of the passport, visa or national identity document, the user must verify the requirements demanded by the regulations of the country to visit. Obtaining the passport or any other required requirement will be at your own expense. Clients should consult with the consular representations or competent organizations about the requirements for entering Peru.

In the event that the documentation is rejected by any authority or entry to the country is denied for not meeting the requirements or for not having it, Machupicchu Chaska Explore Travel Agency will not be responsible for additional expenses or reimburse the price of the trip. Those under 18 years of age must carry a written permit signed by their parents or guardians, in anticipation that it may be requested by any authority, as long as the children do not travel with their parents.

Necessary documentation for your trip.

You must include the name and surname of the passengers as they appear on their documentation (DNI, Passport).

It is the responsibility of each passenger to ensure that they have valid travel documentation that meets the requirements of the airline, immigration and the Peruvian authorities.

Note that:

-A valid travel document is required for all traveling passengers (including infants and minors)

-To ensure compliance with all regulations, passengers must carry a valid passport (and visa, if applicable) or a national identity document issued by their government. The passenger will be responsible for the fines, penalties or expenses resulting from the breach of this requirement.

-Residence cards, driver’s license, family books, maritime identification books, police report (issued in case of loss of the travel document or theft), military IDs, among others, will NOT be accepted as valid documents. Expired or damaged photo IDs will not be accepted.

We recommend that you contact the appropriate authorities so that minors traveling in your reservation have their own documentation to travel.

Minors:

For the purposes of an air service, minors are considered to be those passengers who are under 18 years of age on the date of the flight. Within the minors, they are classified into several groups:

– Babies: Those passengers who have not reached the age of 2 on the date of the flight. They do not occupy a seat in any type of transport and travel accompanied by an adult, paying a variable percentage of the adult fare.

– Children: Those passengers who have already turned 2 years old, but have not yet turned 12 years old, on the date of departure of the flight. They occupy seats and pay a variable percentage of the adult fare.

– Young people: Those passengers who are between 12 and 18 years old at the date of departure of the trip. They occupy a seat and pay the adult rate.

As a general rule, minors travel accompanied by an adult. The Machupicchu Chaska Explore Travel Agency will not manage trips for unaccompanied minors.

Minors traveling accompanied by an adult:

As a general rule, regular line airlines usually accept for each adult passenger a maximum of:

  • A baby.
  • A baby and a child under 5 years old.
  • Two children under 5 years old.

To be able to fly accompanied by minors in the rest of the cases, it is advisable to expressly check with the airline before making the reservation to confirm if it is viable or not.

1. Adventure Travel:

All mountain activities carry risks. The guide will manage them to maximize the safety of the participants, but can never fully guarantee it.

It is the responsibility of the client to inform the company of any type of allergy, injury or illness that they may have had and that may affect them during the activity. It is also the client’s responsibility to attend to the guide’s instructions, and act based on the guide’s instructions.

The guide/supplier may decide to suspend the activity before its start due to weather conditions up to 24 hours before the activity, in this case the client will have the right to reserve other dates at the same price.

1. Claims

Machupicchu Chaska Explore Travel Agency recommends that the User, if he wishes to make a claim for the non-execution or incorrect execution of the Contract, first go to the hotel or the supplier in the place, exposing his claims within 24 hours after his arrival. 

If you have not received an adequate response to your claim, we recommend that you send it in writing to the hotel or supplier, and also send a copy to the Machupicchu Chaska Explore Travel Agency to the following email address: info@machupicchuchaskaexplore.com

The consumer may claim in writing the non-execution or poor execution of the contract before the Machupicchu Chaska Explore Travel Agency within a maximum period of 30 days, counted from the day the trip was to end.
